    How to safeguard yourself against harassment by police or chor party?

    How to safeguard yourself against harassment by police or chor party?

    Pl follow the below-mentioned guidelines:

     

    1. Don’t visit any police station without written notice.
    2. Whenever you are visiting these places then use mobile camera, pen camera, etc for recording the video footage.
    3. Do not visit these places alone. Take friends and relatives with electronic gadgets for video recording.
    4. Create evidence of Illegal Detaining/ Beating/ Harassment by police.
    5. File RTI immediately and ask CCTV footage from the concern police station if you have faced any harassment from police.
    6. Install CCTV camera at your residence.
    7. If your chor party had filed police complaint then take anticipatory bail/ transit bail immediately.
    8. Open Twitter account and send tweets on harassment from police /chor party.
    9. Always submit written complaint and take acknowledgment from police.
    10. Send this complaint to higher authorities & other agencies eg DGP, PC, law ministry, home ministry, human rights commission, chief justice of high court and supreme court, registrar, CM, PM, Police complaint authority, etc.
    11. File Criminal writ petition in high court if you are not getting justice from these authorities.  A sample writ petition is enclosed for reference. ( Delhi High Court, WP(Criminal) 679/2021, Umair Siddiqui vs State of Delhi, date of order: 23.03.2021)

    12. If chor party had abused in the court then immediately file written complaint to your judge and also submit complaint to nearest police station.
    13. When cases are going on in the court/ police station, then never talk, never send message and do not do any interaction with your chor party/ her relatives/ her advocates.
    14. Dial police helpline number and ask for police protection in case of threat.
    15. Create/collect evidence for your cases
    16. Attend our weekly meetings regularly.
    17. Be active in Twitter.

     

     

    Delhi High Court Directs Delhi Police For Report On Alleged Illegal Detaining And Beating Of Man In Matrimonial Dispute Matter

    A Single Judge Bench of Justice Anu Malhotra of the Delhi High Court has issued notice on a petition alleging illegal detaining and beating of a man involved in a matrimonial dispute by the Delhi Police and directed the police to to file a status report on the incident.

    The alleged incident took place at the Turkman Gate Police Post at New Delhi, and the petitioner, one Umair Siddiqui, has stated that the entire incident would have been the recorded and stored in the two CCTV cameras installed at the Turkman Gate Police Post. He submitted that the police had “illegally detained the petitioner and others and mercilessly beaten them.”

    Aggrieved by the police’s malfeasance as well non-registration of FIR on the said incident, the petitioner therefore moved the Delhi High Court seeking an impartial preliminary inquiry and the placing on record of all CCTV footages pertaining to the incident.

    Inter alia, the petitioner has also highlighted the police’s non-compliance with the guidelines laid down by the Supreme Court in the case of Lalita Kumari vs Govt. of UP, wherein the court held that an FIR ought to be registered by the police where the complaint makes out the commission of a cognizable offence.

    The grievance of the petitioner is that the police neither concluded the Preliminary Inquiry within the stipulated period of 15 days nor initiated any legal action against the alleged delinquent police officials nor registered any FIR on the instant complaint.

    In this regard the petitioner has also prayed the court to “formulate a pragmatic mechanism to ensure strict compliance of the directions as contained in the Supreme Court judgment.
