HC of MAHARASTRA
Vague allegations in complaint against husband – Mere allegation of conspiracy for committing offence under Section 494, IPC – Not sufficient ground to implicate husband unless some overt act established on part of husband as abettor – Prima facie complainant was trying to ventilate his personal grievances and seek personal vendetta against present petitioners – Allegations are totally unfounded and issuance of process and proceeding with prosecution of present petitioners would be an abuse of process of law.
