SC of India directed to settle case registred under section IPC 494 by wife, and ordered husband to pay 5 Lakh. The issue rise after ex-party divorce granted by district courrt, which was set aside by High Court.

Vague allegations in complaint against husband – Mere allegation of conspiracy for committing offence under Section 494, IPC – Not sufficient ground to implicate husband unless some overt act established on part of husband as abettor – Prima facie complainant was trying to ventilate his personal grievances and seek personal vendetta against present petitioners – Allegations are totally unfounded and issuance of process and proceeding with prosecution of present petitioners would be an abuse of process of law.
